The defendant, Leonard Carter, was charged by bill of information with distribution of marijuana, a violation of LSA-R.S. 40:966 (A)(1). After a jury trial, the defendant was convicted as charged and sentenced to serve twenty years at hard labor. The defendant appeals, urging that the evidence is insufficient to support a conviction of distribution of marijuana and that the sentence is excessive. We affirm the defendants conviction. However, the sentence is vacated and the case is remanded to the district court for resentencing.
